Worker records define the class
The WellNow wage-and-hour settlement administrator lists November 25, 2026 as the claim deadline, following notice mailing on September 23. The proposed settlement concerns workers and disputed pay practices, not compensation for patients or a telehealth privacy claim. WellNow denies liability.
The notice defines hourly employees as non-exempt workers with direct patient-care duties and sets different work periods for New York, Illinois and Pennsylvania. New York starts June 6, 2017; some Illinois claims start June 8, 2016, while other Illinois and Pennsylvania groups start June 8, 2023. The preliminary approval date ends the relevant periods.
Payment and doing nothing have different consequences
The gross fund is up to $1.64 million, with approved fees, costs and other deductions before worker allocation. Pay periods and the allocation formula determine shares. The notice treats half of a payment as wages subject to withholding and half as non-wage liquidated damages and interest, so a gross estimate is not the amount deposited.
People who do nothing may receive no payment yet still release certain state-law claims; returning the claim form also releases specified federal wage claims. The administrator explains the options and a December 16 final hearing. Check your notice pay periods and the instructions for disputes before November 25 rather than assuming the employer records are correct.
