Pennsylvania Attorney General Dave Sunday announced October 13, 2026 that his Antitrust Section filed a complaint in Commonwealth Court against drugmakers and pharmacy benefit managers over alleged collusion to manipulate insulin prices and raise patients’ out-of-pocket costs. The claims are allegations.
Defendants include Eli Lilly and Company, Novo Nordisk Inc. and Sanofi-Aventis US LLC, and numerous PBMs including Express Scripts, CVS Caremark and Optum Rx. The complaint alleges violations of Pennsylvania’s Unfair Trade Practices and Consumer Protection Law, plus unjust enrichment and civil conspiracy, and alleges the parties conspired to inflate insulin prices by more than 1,000 percent.
The office says about 1.3 million Pennsylvanians have diabetes and 3.5 million more have prediabetes, and that diagnosed diabetes costs the state an estimated $16.4 billion a year. The complaint seeks structural changes to bring costs down to fair market prices and give patients options, restitution for people harmed, civil penalties and costs.
