Residual cash can pair with qualifying loss claims

Peco Foods’ data settlement lists October 12, 2026 for exclusions and objections and November 9 for claims. The $950,000 proposal concerns a December 2023 breach and United States individuals whose personal information was accessed or acquired under the incident notice terms.

The FAQ describes ordinary documented expenses up to $1,000, qualifying extraordinary losses and attested time under a $5,000 category, three years of monitoring and residual cash estimated at up to $550. Here the residual payment may be claimed in addition to qualifying loss categories, rather than always replacing them.

The gross fund must first cover other costs

But residual means remaining funds after approved monitoring, loss payments, administration, fees and awards. The administrator says it may be less than $550. It is not a fixed payment that can be promised from the gross fund or added to every claimant’s household budget.

Final approval is scheduled December 14. Loss categories require the notice documentation and incident connection; a benefit cap is not evidence an expense occurred. Peco denies wrongdoing. Keep the breach notice, records and claim confirmation, and distinguish the October rights choices from the later November benefit filing.
