New York's attorney general announced September 16 that two Westchester DARCARS dealerships agreed to more than $1 million in customer refunds over sales-commission charges and an add-on bundle. The affected dealers are DARCARS Lexus of Mount Kisco and DARCARS BMW. The settlement concerns specific transactions, not every purchase from the DARCARS group.
The attorney general says DARCARS Lexus must return $892,671.26 to people charged a sales-commission fee from October 23, 2021 through May 30, 2022. Both dealers must make additional reimbursements totaling $281,847.72 connected to misleading add-on practices. The office says thousands who bought or leased cars may be eligible and the dealers must stop the described fee practices. The amounts are aggregate obligations, not an individual check estimate.
If you bought or leased at either location in the affected period, keep your signed contract, itemized sale and lease paperwork and any correspondence. Look for sales-commission fees and DARCARS Assurance charges; the state's release provides the exact dealer names and settlement terms. Do not pay an outside 'claims agent' to tell you whether the state has identified you. Ask the attorney general's office or dealership about your particular transaction, rather than assuming the settlement covers every add-on from every dealer.
