Affected migration-server files define the incident

Modernizing Medicine’s data settlement accepts claims through November 2, 2026. The incident involved two servers used to move limited data from retiring electronic health-record platforms to the current platform and was discovered in July 2025. A doctor using ModMed does not by itself establish that every patient was affected.

The $2,999,750 gross fund covers approved deductions before net benefits. Eligible people may choose documented incident losses up to $5,000 or an estimated $75 alternative. Two years of medical-data monitoring can accompany the cash choice. The $75 is variable, not a guaranteed floor.

The administrator describes a fallback, not guaranteed approval

The FAQ says if a loss claim lacks reasonable supporting documentation or is rejected and the claimant fails to cure it, the claim is treated as the alternate-cash election. That is a specific settlement rule, not permission to invent losses or an assurance that an ineligible person will receive money.

Qualifying losses must fall between July 9, 2025 and November 2, 2026 under the notice. Exclusions and objections are due October 19; final approval is scheduled November 17. Preserve receipts, respond to any cure request and keep claim confirmation. ModMed denies wrongdoing, and payment still depends on final approval.
