A particular collection lawsuit defines the class

The Guadalupe Credit Union administrator lists November 30, 2026 for objections and exclusion requests in its proposed collection-practices settlement. The class covers people sued by the credit union in Santa Fe County Magistrate Court without representation by a New Mexico-licensed attorney in that action.

The proposal pays the amount collected after the filing of the collection lawsuit plus $1,000 per class member. Where a lawsuit named more than one person, payment is joint unless acceptable arrangements are made. That detail matters before assuming each recipient gets a separate refund check.

A joint lawsuit can mean a joint payment

The notice says no action is required to receive money beyond ensuring the administrator has contact information. It also requires the credit union to stop filing these lawsuits without attorney representation. Cash, a refund of past collections and a future practice change are different parts of the proposal.

The fairness hearing is scheduled February 3, 2027 at 10 a.m. The credit union has not admitted wrongdoing. Payment and the release depend on approval.
