The Federal Trade Commission, joined by the Utah and Nevada attorneys general, sued contact lens retailer Lens.com Inc. on October 2, 2026 in the U.S. District Court for the District of Nevada. The complaint also names owner Cary Samourkachian and affiliate Speed Commerce LLC. The FTC voted 2-0 to file, and the court will decide the case.
The complaint alleges Lens.com advertises low prices in sponsored Google search ads and on its website, then adds a mandatory “Taxes & fees” charge at checkout that routinely doubles the price and costs consumers hundreds of millions of dollars. It says the line item sits below the visible part of the screen while a prominent “Continue” button encourages shoppers to proceed, so many never see it. It also says the label suggests state sales tax, although many states exempt contact lenses from sales tax or have none.
The complaint further alleges the same low prices lure shoppers into the AutoRefill subscription without clear disclosure of the charge, and that Lens.com buries how and by when to cancel to avoid a future shipment. The plaintiffs allege violations of the FTC Act, the Restore Online Shoppers’ Confidence Act, the Gramm-Leach-Bliley Act and Utah and Nevada consumer laws.
