The three-mile area and incident date define eligibility

The CSX Livingston derailment settlement asks qualifying residents and property owners to establish eligibility by October 19, 2026. The $1.5 million case concerns the November 22, 2023 derailment in Rockcastle County, Kentucky.

The class area is a three-mile radius centered on the derailment site. Applicants must have lived there or owned qualifying residential property on the incident date and supply proof such as a utility bill, license or ownership record. Living near Livingston today is not the same test.

Earlier payments affect the result

The notice describes shares of the net fund up to $4,000 per residential household and property owner, subject to an offset for prior CSX payments. Approved fees and administration also affect net funds. Do not assume every person in one household receives a separate full cap.

Exclusion and objection dates passed October 5. CSX denies wrongdoing and payments require final approval and resolved appeals. Preserve prior-payment records as well as address evidence. A claim form is not confirmation that every asserted loss is reimbursed in full.
