Match the pool, not just the brand

The current Bestway pool settlement administrator sets October 30 as the claim deadline for specified above-ground pools. The class-product definition concerns pools at least 48 inches tall with external compression straps, sold during the covered 2008-2024 period. A different Bestway product is not automatically included.

Under the proposed $15 million settlement, a claimant with valid proof of purchase may receive 10 percent of the actual price shown, or of the identified product's average retail price when the proof does not show the price. Claimants without valid proof of purchase have a $40 cash-payment route, subject to a timely valid signed claim.

Keep compensation and safety separate

The fund also pays notice, administration, approved legal costs and service awards. The advertised fund is not a per-household refund, and an unverified receipt or a different pool model does not establish the payment condition. Review the class-product list before submitting a claim.

The administrator states that the settlement does not limit rights under the pool recall. Do not treat a payment claim as a safety repair or permission to keep using a recalled configuration. The approval hearing is scheduled for November 20, and payment still depends on approval and the settlement becoming effective.
